Scientists have figured out how to take CBD and convert it into Delta-8 and Delta-9-THC, which is why you could find these synthetics in states where cannabis was not legal.
Is Delta-8 Legal Now?
Synthetics like these used to fall in a legal gray area.
However, as of August 21, 2020, the DEA ruled that all cannabinoids, including synthetic ones, are controlled by The Controlled Substances Act and are considered Schedule 1 substances.
Therefore, Delta-8, whether synthetically or naturally occurring, is now officially illegal.
Will Delta-8-THC Cause You to Fail a Drug Test?
Yes, absolutely. Any THCs whether it’s THC-A—a cannabinoid that does not get you high—or THC-B, Delta-8, Delta-9, and even CBN, will all cause you to fail a drug test.
